UNITED SA Federal Credit Union E-Teller Online Financial Services Agreement and Disclosure

This Online Financial Services Agreement and Disclosure governs your use of Online Financial Services. By using Online Financial Services, you agree to all of the terms of this Agreement. Please read it carefully and keep a copy for your records.

Definitions

You or Your – The person(s) subscribing to or using Online Financial Services.
We, Us, or Our – Refers to UNITED SA Federal Credit Union (UNITED SA) and any agent, independent contractor, designee, or assignee UNITED SA may involve in the provision of Online Financial Services.
Business Day – Any calendar day other than Saturday, Sunday, or any holidays recognized by UNITED SA.

Privacy Statement. UNITED SA understands how important privacy is to our members. We have taken steps to ensure your security and privacy for your personal and financial dealings with the credit union. Our member Privacy Policy may be accessed on the credit union Web site.

Eligibility. E-Teller service is open to all UNITED SA members, subject to credit union approval.

Registration Process. Online Financial Services requires the member to complete the initial registration process. This involves completing the application available on the credit union Web site, by mail or at any UNITED SA office. Allow up to ten business days for processing.

When your application for E-Teller is approved, you may use a personal computer or mobile device to access your accounts. You must use your username and password to access your accounts. E-Teller is accessible seven days a week, 24 hours a day. You will need a personal computer, mobile device, and Internet access. You are responsible for the installation, maintenance and operation of any software and your computer. UNITED SA will not be responsible for any errors or failures involving any telephone service, Internet service, software installation or your computer. In addition, UNITED SA is not responsible for any electronic virus or viruses that you may encounter. We encourage our members to routinely scan their PCs and diskettes using a reliable virus product to detect and remove any viruses. Undetected or unrepaired viruses may corrupt and destroy programs, files and possibly hardware.

Log–On Security. Security is very important to the Online Financial Services system. At the time you request the service, the credit union will assign a temporary unique password to you to use the first time you access your account. Once you have logged on, you will be prompted to change your password for future use. To assist members in making a good secure password selection, the system disallows passwords associated with your account number, date of birth, social security number, address, zip code, city, state and name. The password must meet the following requirements:

  • Must be at least eight characters but not more than 16 characters,
  • Must contain at least six alpha characters,
  • Must contain at least one digit (0-9),
  • Must contain at least one special character (non alpha-numeric),
  • Password is case sensitive.

To help prevent unauthorized access and ensure the security of your accounts, we will terminate your online session after 30 minutes. This is to protect you in case you accidentally leave your computer unattended after log on. When you return to your computer, you will be prompted to re-enter your password and your session will continue.

Because your password is used to access your accounts, it should be treated as any other sensitive personal data. You should carefully select a password that is difficult to predict. Keep your password in a safe place and never communicate it to anyone. You may consider changing your password occasionally. This can be done at any time once you have logged on to the E-Teller.

Types of Transactions. At the present time, you may use E-Teller to:

  • Review account information and transaction history for savings, checking, money market, share certificates, IRA and loan accounts.
  • Transfer funds between qualifying accounts under your account number.
  • Transfer funds from your qualifying accounts to qualifying accounts of other members you authorize through Member Services.
  • Transfer funds to make payments on UNITED SA loans under your account number.
  • Request a withdrawal from your savings, checking, money market or line of credit loan advance by check to be mailed to you.
  • Download your account information to financial management software programs.
  • Conduct other transactions permitted by UNITED SA.
 

By initiating a transfer or payment through E-Teller, you authorize UNITED SA to withdraw the amount of the requested funds from the designated account in order to complete the transaction.

Transactions involving your deposit accounts will be subject to terms of your account agreement and transactions involving your line of credit will be subject to your loan agreement and disclosures, as applicable.

You agree that requests received by UNITED SA via E-Teller, including, but not limited to, requests pertaining to account information, new account services, new loans, and changes to accounts, are legally authorized by you. As such, UNITED SA shall be entitled to consider that such requests have the same legal authority as a written request signed by you for such information, services, or actions.

Service Limitations. The following transaction limitations apply when using the services listed above:

Transfers. You may transfer or withdraw up to the available balance in your account or up to the available credit limit on a line of credit at the time of the transfer, except as limited under this Agreement or your share or loan agreements. UNITED SA reserves the right to refuse any transaction that would draw upon insufficient or unavailable funds or lower an account below a required balance.

Savings and Money Market Accounts. Please refer to the Membership and Account Agreement for information regarding transaction limitations for these accounts. If you exceed the transfer limitations, your account will be subject to closure by the credit union.

Account Information. The account balances and transaction history information may be limited to recent account information involving your accounts. Also, the availability of funds for transfer or withdrawal may be limited due to our Funds Availability Policy.

E-Mail. UNITED SA may not immediately receive e-mail communication that you send and we will not take action based on e-mail requests until we actually receive your message and have a reasonable opportunity to act. If you need to contact UNITED SA immediately during normal business hours, you may call us at (210) 561-4500 (in San Antonio) or 1-800-531-8456 (outside San Antonio).

Password. The password or access code issued to you is for security purposes. The password is confidential and should not be disclosed to third parties or recorded. You are responsible for safekeeping your password. You agree not to disclose or otherwise make your access code available to anyone not authorized to sign on your accounts. If you authorize anyone to use your password, that authority shall continue until you specifically revoke such authority by notifying UNITED SA in writing. If you fail to maintain the security of your password and UNITED SA suffers a loss, we may terminate your E-Teller access and account services immediately.

Liability for Unauthorized Access. You are responsible for all transfers you authorize under this Agreement. If you permit others to use E-Teller or your password, you are responsible for any transactions they authorize or conduct on any of your accounts. However, inform the credit union at once if you believe anyone has used your password or accessed your account through E-Teller without your authorization. If the credit union is notified within two business days, you are liable for no more than $50.00 if someone accessed your account without your permission. If you do not notify the credit union within two business days after an unauthorized use of your account or password, and the credit union can offer proof the transaction could have been prevented had we been notified, you could be liable up to $500.00.

In addition, if your statement indicates E-Teller transfers that you did not make, notify us at once. If notification is not made within 60 days after the statement was mailed to you, money may be forfeited after the 60 days.

Business Days. Our business days are Monday through Friday from 9:00 a.m. until 5:00 p.m. except for federal holidays.

Fees and Charges. Currently, there are no charges for E-Teller, but it is subject to change. We will notify you of any changes as required by law. If you request a transfer or check withdrawal from your line of credit account, such transactions may be subject to charges under the terms and conditions of your loan agreement.

Periodic Statements. Transfers and withdrawals transacted through E-Teller will be recorded on your periodic statement. You will receive a statement monthly unless there is no transaction in a particular month. In any case, you will receive a statement at least semiannually.

Account Information Disclosure. We will disclose information to third parties about your account or the transfers you make:
1. To comply with a government agency or court orders;
2. If you give us your written permission.

UNITED SA Federal Credit Union’s Liability For Failure To Make Transfers. If we do not complete a transfer from your account on time or in the correct amount according to our agreement with you and the instructions you transmit, the credit union will be liable for actual losses or damages. However, UNITED SA will not be liable:

  • If, through no fault of ours, you do not have adequate funds in your account to complete a transaction, your account is closed, or the transaction amount would exceed your credit limit on your line of credit, if applicable.
  • If you used the wrong password or you have not properly followed any applicable computer Internet access, or UNITED SA user instructions for making the transaction.
  • If your computer fails or malfunctions or E-Teller was not properly working and such problem should have been apparent when you attempted such transaction.
  • If circumstances beyond our control (such as fire, flood, telecommunication outages, postal strikes, equipment or power failure) prevent making the transaction.
  • If the funds in your account are subject to an administrative hold, legal process or other claim.
  • If you have not given UNITED SA complete, correct and current instructions so we can process a transfer.
  • If the error was caused by a system not under the control of UNITED SA, such as that of your Internet Service Provider.
  • If there are other exceptions as established by UNITED SA on occasion.
 

Termination of E-Teller. You agree that we may terminate this Agreement and your use of E-Teller if you or any authorized user of your account breaches this or any other agreement with us, or, if we have reason to believe that there has been an unauthorized use of your account or password.

You or any other party to your account can terminate this Agreement by notifying us in writing. Termination of service will be effective the first business day following receipt of your written notice. However, termination of the Agreement will not affect the rights and responsibilities of the parties under this Agreement for transactions initiated before termination.

Notices. UNITED SA reserves the right to change the terms and conditions upon which this service is offered. UNITED SA will mail a notice to you at least 21 days before the effective date of any change, as required by law. Use of E-Teller is subject to existing regulations governing your accounts and any future changes to those regulations.

Billing Errors. In case of errors or questions about your E-Teller transactions, telephone us at (210) 561-4500 (in San Antonio) or 1-800-531-8456 (outside San Antonio) or write to UNITED SA, Member Services Department, 5500 UTSA Boulevard, San Antonio, Texas 78249-1622, or send an e-mail to credit.union@unitedsafcu.org as soon as possible. The credit union must be notified by you no later than 60 days after receipt of the first statement on which the problem appeared. In your correspondence:

  • Tell us your name and account number.
  • Describe the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  • Tell us the dollar amount of the suspected error.
 

If you supply verbal notification, the credit union may require you mail your complaint or question in writing within ten calendar days. We will determine whether an error occurred within ten business days after notification and will attempt to correct any error promptly. If determined additional time is needed, the credit union may take up to 45 days to investigate a complaint or question. If determined, the credit union will credit your account within ten business days for the amount in question, in order for the use of the funds during the investigative process. If the credit union has requested your complaint or concern in writing and it has not been received within ten business days, the credit union reserves the right to credit your account.

The credit union will notify you of the results within three business days after completion of the investigation. If it was determined there was no error, written explanation will be forwarded to you. You may request copies of the documents utilized in our investigation.

Enforcement. You agree to be liable to UNITED SA for any liability, loss, or expense as provided in this Agreement that UNITED SA incurs as a result of any dispute involving your accounts or services. You authorize UNITED SA to deduct any such liability, loss, or expense from your account without prior notice to you. In the event either party brings a legal action to enforce the Agreement or collect any overdrawn funds on accounts accessed under this Agreement, the prevailing party shall be entitled, subject to applicable law, to payment by the other party of its reasonable attorney’s fees and costs, including fees on any appeal, bankruptcy proceedings, and any post-judgment collection actions, if applicable.

Governing Law. This Agreement shall be governed by the Federal Credit Union Act, the Rules and Regulations of the National Credit Union Administration, the credit union’s Bylaws as they now exist or may be hereafter amended, and, solely to the extent not preempted by federal law and the laws of the State of Texas. You agree that if there is any inconsistency between the terms of the Agreement and any applicable law, regulation, or rule, the terms of this Agreement will prevail to the extent of any such law, regulation, or rule may be modified by agreement between parties.
